FCK Initiates Ticket Exchange Campaign and Asks for Understanding
On Monday, December 7, 2009, 1. FC Kaiserslautern initiates a ticket exchange campaign for tickets for the cancelled game against LA Galaxy.
Tickets for the friendly encounter between FCK and LA Galaxy, which was scheduled for November 26, 2009, may be exchanged for tickets for one of the first five second-leg home games of FCK. 1. FC Kaiserslautern has been trying to persuade the Canadian IMC Group Inc., organizer of the LA Galaxy’s postseason tour and the game in Kaiserslautern, to undertake a reverse transaction and retransmit the ticket proceeds to FCK. Due to the fact that IMC Group Inc. did not react and let pass the final legal deadline although it had assured to assume full responsibility for ticket refunds, FCK was compelled to take legal steps.
“Since IMC Group Inc. is the sole organizer and promoter of the game, we are not legally bound to compensate ticket holders”, Stefan Kunz, chairman of the FCK board of management, comments on the situation. “And even if FCK neither is to blame for the cancellation of the game nor for any inconveniences, we feel to be bound by honor to compensate our loyal fans. Therefore, we have worked out a compensation model for the ticket buyers.”
This model offers two methods of compensation.
1. Any buyer of a ticket for the game against LA Galaxy shall receive a credit note to the equivalent value of ticket(s). This credit note shall only be redeemed for one of the next five home games of FCK. The credit note shall automatically expire otherwise. Credit notes cannot be exchanged for cash, either in whole or in part. It is not possible to purchase merchandising articles with this credit note.
2. . Any buyer of a ticket for the game against LA Galaxy shall have the possibility to exchange this ticket for a ticket for one of the first five second-leg home games of FCK. Tickets shall be upgraded to the next category. E.g. in exchange for a €20 standing room only ticket, the ticket holder shall receive a €22 seat ticket.
As a countermove, any ticket buyer who takes part in the ticket exchange shall sign an assignment of claims, in which he or she assigns any claims against IMC Group Inc. to 1. FC Kaiserslautern.
The ticket exchange shall only be possible on presentation and return of the ticket(s). Presentation and return shall only be carried out at FCK Service Center or via regular mail to the FCK ticketing department.
